Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of doubao.photos ("Service"), operated by Lustermount LLC ("we", "us", "our"). The Service is an AI image generation tool powered by ByteDance Doubao Seedream models via Volcengine Ark.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

The Service uses Google sign-in via Supabase for authentication. By signing in, you authorize us to access your Google profile information (name, email address, and profile picture) to create and maintain your account.

You are responsible for maintaining the security of your Google account and for all activity that occurs under your doubao.photos account.

3. Service Description

doubao.photos provides AI-powered image generation capabilities, including:

  • Text-to-image generation from text prompts
  • Image-to-image transformation using reference images
  • Prompt-based image editing
  • Prompt enhancement
  • Image download and generation history

Image generation is performed by ByteDance Doubao Seedream models accessed through the Volcengine Ark API. The quality, accuracy, and content of generated images depend on the underlying model and your input prompts.

4. Credits, Payments, and Pricing

The Service operates on a credit-based system. Each image generation consumes credits based on the model tier selected.

  • Free tier: Signed-in users receive a limited number of free daily credits. Guest users may receive limited trial generations.
  • Credit packs: Additional credits can be purchased through our pricing page. Current plans include Starter (80 credits), Creator (200 credits), and Pro (500 credits).
  • Payment processing: All payments are processed by Creem (Armitage Labs OU), which acts as the Merchant of Record. Creem handles payment processing, invoicing, and applicable tax collection on our behalf.

Pricing is subject to change. We will provide reasonable notice of pricing changes. Existing purchased credits remain valid regardless of pricing changes.

5. Refund Policy

No refunds after credit deduction. Once a generation job has started and credits have been deducted from your balance, those credits are non-refundable. This applies regardless of whether you are satisfied with the generated result.

  • Failed generations: If a generation fails due to a provider or system error, the reserved credits are automatically refunded to your balance.
  • Unused credit packs: If you have purchased a credit pack and have not consumed any credits from it, you may request a refund by contacting support@doubao.photos within 7 days of purchase.

For disputes regarding charges, contact us at support@doubao.photos. We will review each case individually and respond within 14 business days.

6. User Content and Intellectual Property

Your content: You retain ownership of the prompts you write and the images you upload to the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (including transmitting prompts and images to the Volcengine Ark API for generation).

Generated images: Subject to these Terms and the Volcengine Ark acceptable use policies, you receive usage rights to the images generated through your use of the Service. We do not claim ownership of your generated outputs.

No guarantee of uniqueness: AI-generated images may be similar to images generated for other users using similar prompts. We do not guarantee that generated images are unique or free from resemblance to other works.

Platform IP: All rights in the Service itself, including its design, code, branding, and documentation, remain the property of Lustermount LLC.

7. Acceptable Use

You agree not to use the Service to:

  • Generate, upload, edit, transform, distribute, or attempt to create NSFW, pornographic, sexually explicit, sexually suggestive, nude, erotic, fetish, or adult sexual content
  • Generate, upload, or distribute illegal content
  • Create child sexual abuse material (CSAM) or any sexual content involving minors
  • Generate sexualized images of real people, public figures, private individuals, or fictional characters
  • Generate non-consensual intimate images, sexual deepfakes, face swaps, impersonation content, or identity manipulation of real individuals
  • Create content that promotes violence, hatred, harassment, or discrimination
  • Generate content that infringes on third-party intellectual property rights
  • Produce spam, malware, phishing materials, or deceptive content
  • Attempt to reverse-engineer, extract, or replicate the underlying AI models
  • Circumvent usage limits, credit systems, or access controls
  • Use the Service in any manner that violates applicable laws or regulations

You must also comply with the acceptable use policies of our AI model provider, Volcengine Ark. Violations may result in immediate account suspension or termination without refund. Our separate Acceptable Use Policy is incorporated into these Terms.

8. Third-Party Services

The Service relies on third-party providers. Your use of the Service is also subject to the terms and policies of these providers:

9. Children's Privacy and Minor Protection

The Service is not directed at children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected data from a child under 13, we will delete that information promptly.

Users between 13 and 18 must have parental or guardian consent to use the Service. Parents or guardians who believe their child is using the Service without consent should contact us at support@doubao.photos.

We comply with the Children's Online Privacy Protection Act (COPPA) and the age-related provisions of the General Data Protection Regulation (GDPR).

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that generated images will meet your expectations or requirements. AI-generated content may contain inaccuracies, artifacts, or unintended elements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUSTERMOUNT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

You may stop using the Service at any time. You may request account deletion by contacting support@doubao.photos.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

Upon termination, your right to use the Service ceases immediately. Unused credits are non-transferable and are forfeited upon account termination, except where prohibited by applicable law.

13. Dispute Resolution

If you have a dispute with us, you agree to first attempt to resolve it informally by contacting support@doubao.photos. We will work in good faith to resolve the issue within 30 days.

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Wyoming, USA.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by posting the updated Terms on this page with a new effective date.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
